I am creating an Open Educational Resource (OER) and want to reuse some material under Fair Use. I am licensing the OER under a creative commons attribution license (CC-BY) but i want to alert users that some of the material is not covered by the license.

We would suggest that some variation on the following language be included in your work to alert future users that some materials are protected by copyright and not covered by the Creative Commons license.

All logos and trademarks are property of their respective owners. Sections used under fair use doctrine (17 U.S.C. § 107) are marked. Persons who reuse such materials should ensure that they too enjoy a legal privilege to reuse those excerpts. Teachers and adopters in non-U.S. jurisdictions should rely on the appropriate education, study, and quotation provisions of their own national copyright laws.
